Defective Tires

Defective TireTire Defect Accidents

Your safety is riding on tires. A defective tire can cause an accident or make an accident worse. People can be severely injured or killed when the manufacturers and sellers of tires fail to take the necessary care to make sure you have the proper tires for your car or when tires are manufactured with defective materials or processes.

It is difficult for a tire buyer to know if a tire is defective. We depend on the manufacturer or the retailer to make sure we have the right tires.

  • Aged Tires: Tires age while sitting on a shelf. A six-year-old tire that has never been used can be dangerous when placed on your car. A tire may have been in the manufacturer’s warehouse or on the retailer’s shelf long after its useful and safe life. There are date codes on tires, so the retailer knows when a tire is too old. If it is sold to you, despite its age, and if it causes an accident, you have the right to compensation.

  • Mismatched Tires: If a retailer sells you a tire that is not the right size for your tire rim, then that retailer can be held liable for an accident caused by having the wrong size tire.

  • Used Tires: Sometimes a retailer will sell a used tire for the consumer to use as a spare. The seller knows better. Old tires are not safe tires, no matter how much tread wear they show or how briefly they are to be used.

  • Defective Materials: When a manufacturer uses defective materials, the resulting tires will be defective and can cause accidents.
